Selling these items is punishable with jail terms and some of the highest fines in the Criminal Code. The Arizona Republic reports (http://bit.ly/116Sp03 ) that the Arizona Prosecuting Attorneys&#8217; Advisory Council voted last week to no longer support Senate Bill 1440 because it conflicts with an argument prosecutors are making in a case before the Arizona Supreme Court. That case involves a Yuma County Superior Court judge who ordered the Sheriff&#8217;s Office to return marijuana seized from a California woman who had permission to use the drug for medical purposes. SB 1440 would make it illegal to sell or advertise products that are packaged in any way that suggests that it is anything other than for medicinal use. Rep. Kimberly Yee, R-Phoenix, said she saw evidence that sodas with medical marijuana were being put into bottles that looked suspiciously like other over-the-counter brands. And she said some items were being sold that looked a lot like brand-name chocolate bars. The legislation, given preliminary Senate approval on a voice vote, spells out that any labeling can be only black text on a white background. Thursday&#8217;s action came over the objections of the Arizona chapter of the American Civil Liberties Union. Attorney Anjali Abraham said her organization has no problem with strict labeling requirements. 		<description><![CDATA[As the father of two young boys, I have great respect for the good work of Keep Arizona Drug Free, even as I may disagree with their political punditry, as expressed in the Feb. 22 commentary “Marijuana legalization is far from inevitable.” The point of the piece was seemingly to give political safe harbor to elected officials seeking to re-vote and repeal Arizona’s thrice- approved medical marijuana law. It did so with red herrings, mixing observations about full marijuana legalization and medical marijuana programs. But the current discussion isn’t about full legalization. It is about whether Arizona voters will be respected and whether a well-regulated medical marijuana program will have a chance to prove itself here. I do not wish to re-litigate the 2010 campaign that enabled the current program. There are good people and arguments on both sides. But when an advocacy organization goes astray to mistakenly play political consultant, it justifies a response. 		<description><![CDATA[The case against Nature’s Harvest and several of its employees for allegedly selling medical marijuana and running a criminal enterprise continued Thursday. It was the first case management conference since prosecutors arraigned the business, its founder and an employee. A grand jury indicted Nature’s Harvest founder and director Sheelah Golliglee last month for running a criminal syndicate and selling marijuana. She was the only person taken into custody Feb. 8 when officers from the Navajo County Sheriff’s Office conducted a surprise raid on Nature’s Harvest offices in Payson and Lakeside and Golliglee’s homes. She later posted bond and was released. The raid came after a six-month investigation that included undercover stings where officers reportedly bought medical marijuana from both clinics, including from Golliglee and her executive assistant, Stacy Johanna Palace, said Chief Deputy James Molesa with the Navajo County Sheriff’s Office. 		<description><![CDATA[A research team based in Poland may have discovered that CBD is a major component of the flax plant. The Cannabis plant also makes CBD (Cannabidiol), a miraculous plant compound that demonstrates the potential to treat a wide range of diseases with virtually no side effects. Interestingly, the researchers discovered the presence of CBD in flax accidently. They were analyzing genetically modified flax plants and comparing them to natural flax plants. The team noted that the production of several compounds was slightly enhanced in the GMO plants and decided to identify them. Keep AZ Drug Free has endorsed a bill put forward in the Arizona Legislature asking voters to repeal the medical marijuana legalization measure they narrowly passed in 2010. The Arizona Cardinals football team have been Keep AZ’s largest financial contributor, according to the group. The team donated $10,000 during the 2010 campaign. Proposition 203 passed by 4,000 votes in 2010 and legalized medical marijuana dispensaries and distribution within the state. It has faced legal and bureaucratic hurdles from Gov. Jan Brewer, Maricopa County Attorney Bill Montgomery and others opposed to the marijuana’s law implementation. The new bill, HCR 2003, asks voters to repeal Prop. 203 starting in 2014. Combined, the percentage of 8th, 10th and 12th graders who reported using marijuana at least once in their lives went from 29.9 percent before the law passed to 28.7 percent in 2012, according to statistics in the latest Arizona Youth Survey. 		<description><![CDATA[The Arizona Court of Appeals today denied Maricopa County Attorney Bill Montgomery’s effort to temporarily block the state’s medical marijuana law. Just an hour or so after hearing oral arguments, a three-judge panel rejected the motion to delay a Maricopa County Superior Court judge’s ruling that the law is constitutional. Attorney Tom Liddy, representing the county, said public employees risk prosecution for violating federal drug laws if they process zoning paperwork to allow a Sun City dispensary to open. That puts them at risk of irreparable harm, one of the legal conditions necessary for granting a temporary stay of the law, he argued. PHOENIX (AP) &#8212; A judge will hold a hearing Thursday on whether to temporarily block his recent ruling that Arizona&#8217;s medical marijuana law is constitutional and that federal drug laws don&#8217;t stand in the way of implementing it. The Maricopa County Attorney&#8217;s Office asked Superior Court Judge Michael Gordon to suspend his ruling pending the outcome of an appeal to a higher court. Gordon ruled last week in a case that initially focused on whether the county had to approve zoning for a Sun City dispensary. The case grew to include the larger legal question of whether federal drug laws pre-empt Arizona&#8217;s medical marijuana law. Gordon ruled that they don&#8217;t and that the county must provide zoning clearances for the Sun City dispensary. 		<description><![CDATA[PHOENIX — State and county officials cannot refuse to process applications for medical marijuana dispensaries just because the drug remains illegal under federal law, a trial judge ruled today. In an extensive ruling, Maricopa County Superior Court Judge Michael Gordon rejected arguments by Attorney General Tom Horne and Maricopa County Attorney Bill Montgomery that the dispensaries and growing facilities are preempted by federal law. They argued that precludes public employees from doing anything to let them open, including simply processing the required paperwork. Gordon acknowledged Congress enacted the Controlled Substances Act to combat drug abuse and to the control the legitimate and illegitimate traffic of drugs. That law classifies marijuana as a Schedule 1 drug for which there is no legitimate medical use. And the judge acknowledged that the 2010 voter-approved measure allowing the medical use of marijuana reflects “a very narrow but different policy choice” about the drug. The facility is located in the Gaslight Plaza Shopping Center at the corner of Broadway and Kolb on the East side. The owners tell Tucson News Now they passed the health inspection on Tuesday. Rouben Beglarian and his wife say state health inspectors were here for four hours Tuesday going through a very thorough checklist. 		<description><![CDATA[No need to put away the fluorescent bulbs just yet: &#160; It turns out that Arizona first state-authorized medical-marijuana dispensary won&#8217;t trigger a ban on patient and caregiver grow-rooms, at least in the short term. The state Department of Health Services has granted a &#8220;short delay in the effective date for their Operating License in order to ensure that things run smoothly when they officially begin operations,&#8221; writes DHS Director Will Humble this afternoon in his blog. The length of the delay wasn&#8217;t specified, but for now, new and renewing patients filing applications with the state to legally possess marijuana will still be allowed growing privileges. The approval of Arizona Organix by state Department of Health Services inspectors on Thursday meant the dispensary could immediately begin selling marijuana to qualified patients under the state&#8217;s 2010 medical-pot law. That is a strong statement and one that reminds us of the invasion of Iraq, Guantanamo bay, water-boarding, rendition, and the strong international legal arguments made about these situations. But in this case the violation will be hailed by many as a positive step. On 6 November various ballot initiatives were voted on in the US, from abolishing the death penalty to allowing assisted suicide, to legalising gay marriage. Three had the clearest potential to render the US in breach of international law if they succeeded. With the votes in Colorado and Washington which established a legally regulated framework for non-medical production and sale of marijuana, that breach has now occurred. The laws in question are the 1961 UN Single Convention on Narcotic Drugs and the 1988 UN drug trafficking conventions (which has a longer, duller title). Alongside one other treaty (which deals with synthetics) these form the bedrock legal foundation of the global drug control regime. Most countries follow them very closely, including the US. Arizona Organix in Glendale was inspected by the Department of Health Services Thursday. Inspectors didn&#8217;t find any issues with its security, inventory control, structuring, or records, and gave the company the go-ahead to open. However, the company&#8217;s lawyer told 3TV it will likely wait for several lawsuits by medical marijuana opponents to be adjudicated, and to see how local law enforcement reacts. &#8220;Certainly, a county attorney doesn&#8217;t bring cases of violations of federal law, so if he were to try to bring a violation of state law it would have to be litigated in the courts. 		<description><![CDATA[&#160; Gilbert police, under Chief Tim Dorn, have taken an intolerant view of the cannabis clubs that have sprouted up since voters approved medical marijuana two years ago. &#160; Gilbert PD carried out the first raid in the state, as far as we know, against a club, busting a small cooperative in Tempe back in June of 2011. (That cooperative&#8217;s owner, Garry Ferguson, was never charged.) Last month, the agency&#8217;s crack troops stormed a medical-marijuana club in Mesa, accusing three people of selling marijuana and &#8220;narcotics&#8221; that are really just more marijuana to qualified patients. Other police agencies, including Phoenix, Tempe and several outside of the Valley, have busted cannabis clubs in recent months, but Gilbert is clearly one of the leaders in going after these businesses. Opening a compassion club in Gilbert would seem like a bad idea. But that&#8217;s what 1st Class Compassion did. It didn&#8217;t last long. The place launched a Facebook page in June, and police launched their raid on October 25. The result is a system of justice that is schizophrenic and at times appalling. Though the federal government considers marijuana a Schedule I Controlled Substance and bans its use for medical purposes, a growing number of states feel differently. Today, 18 states and Washington, D.C., have legalized medical marijuana for people suffering from debilitating medical conditions like cancer, epilepsy, severe nausea, multiple sclerosis and chronic pain. And on Tuesday, Colorado and Washington State voted to legalize marijuana for adult use, regardless of medical condition. But these states cannot stop the federal government from enforcing its own laws. And federal drug laws are unjustifiably extreme. He nearly lost the use of his hands after a stroke two years ago. He became debilitated by recurring nightmares of his childhood following his wife&#8217;s death last year. &#8220;But after I found this, everything has been better,&#8221; said the 80-year-old, as he gingerly packed a pipe with marijuana. Rute, who lives at the Hadarim nursing home outside of Tel Aviv, is one of more than 10,000 patients who have official government permission to consume marijuana in Israel, a number that has swelled dramatically, up from serving just a few hundred patients in 2005. The medical cannabis industry is expanding as well, fueled by Israel&#8217;s strong research sector in medicine and technology &#8211; and notably, by government encouragement. Unlike in the United States and much of Europe, the issue inspires almost no controversy among the government and the country&#8217;s leadership. Even influential senior rabbis do not voice any opposition to its spread, and secular Israelis have a liberal attitude on marijuana.
